Approval Authorities

(B) A description of relevant approval authorities and their areas of responsibility.

Department of Environment and Conservation (DEC)

In relation to this project, the Department of Environment and Conservation administers the following Acts:

  • National Parks and Wildlife Act (1974) - approval must be sought from DEC for relocating (Section 87) or destroying (Section 90) Aboriginal artefacts;
  • Protection of the Environment Operations Act (1997) - DEC must be notified when a "pollution incident" occurs that causes or threatens "material harm" to the environment;
  • Threatened Species Conservation Act (1995) - it was assessed that the pipeline would not significantly impact on any threatened species;

Department of Natural Resources (DNR)

The Department of Natural Resources is the proponent for this project and is responsible for administering the following Acts:

  • Native Vegetation Act (2003)
  • Native Vegetation Conservation Act (1997);
  • Rivers and Foreshore Improvement Act (1948);
  • Soil Conservation Act (1938);
  • Water Management Act (2000) - DNR requires works approval for the Murray and Darling River pump stations.

Department of Natural Resources will implement an Independent Environmental Representative (IEMR) whose function will be the monitoring, audit and review of Mitchell Australasia compliance with this CEMP.

Department of Planning

In relation to this project, the Department of Planning administers the Environmental Planning and Assessment Act (1979), which the Department of Natural Resources is the determining authority.

Department of Primary Industries (DPI)

In relation to this project, the Department of Primary Industries administers the Fisheries Management Act (1994). DPI requires notification and concurrence for any reclamation or dredging in waterways/the Anabranch.

Murray Darling Basin Commission (MDBC)

This project is part of NSW Water Recovery Proposal B under the Living Murray program. The project has a total budget of approximately $54 million and is listed on the Eligible Measures Register as part of NSW Package B under the Living Murray. It is the first major infrastructure project in the Murray/Darling Basin to provide significant water savings, improved water supply to landholders and enhanced environmental outcomes.

Roads and Traffic Authority NSW (RTA)

In relation to this project, the RTA administers the Roads Act (1938) in conjunction with Wentworth Shire Council. The RTA requires approval for works within road reserves.

Wentworth Shire Council (WSC)

In relation to this project, the WSC administers the Roads Act (1938) in conjunction with the Roads and Traffic Authority. The WSC requires approval for works within road reserves.

WSC also requires that a Building Certificate be obtained for the pump station buildings.
